Important Notice: These Terms contain provisions that limit our liability and require disputes to be resolved through arbitration. Please read these Terms carefully before using our services.
Welcome to Total Home Hero LLC. These Terms and Conditions govern your use of our website and services. By accessing or using our services, you agree to be bound by these terms.
1. Services Offered
Total Home Hero LLC provides residential home services throughout central Wisconsin, including scheduling and appointment management, service quotes and estimates, billing and invoice generation, online payment processing, and customer account management. Specific service offerings may vary based on location and availability.
2. Licensing and Scope of Work
Total Home Hero LLC is a licensed Wisconsin Dwelling Contractor (License No. 3821-DCFR) operating under a qualified individual license held by Anthony Fons (License No. 3996-DCQ). Total Home Hero LLC is also a Wisconsin-certified lead-safe renovation firm (DHS Certification No. 2883900).
As a licensed Dwelling Contractor, we are authorized to perform construction, remodeling, and repair work on one- and two-family dwellings in Wisconsin as permitted under our license classification. However, the following categories of work require separate trade licenses and are not performed by Total Home Hero LLC:
- Licensed electrical work (panel upgrades, new circuit installation, permit-required electrical)
- Licensed plumbing (new installations, main line work, permit-required plumbing)
- HVAC installation, repair, or refrigerant handling
- Work requiring a license classification beyond our current credentials
If a project requires licensed trade work outside our scope, we will inform you and recommend that you contact an appropriately licensed contractor. Total Home Hero LLC shall not be held liable for any work outside our stated scope.
3. Account Registration
To use certain features of our website, you must create an account. You agree to provide accurate, current, and complete information during registration; maintain and promptly update your account information; maintain the security of your password and account; notify us immediately of any unauthorized use of your account; and accept responsibility for all activities that occur under your account.
4. Scheduling and Appointments
4.1 Booking
When you schedule an appointment through our platform, you are requesting service availability. Appointments are confirmed when you receive a confirmation via email or through your account dashboard.
4.2 Cancellation Policy
Cancellations or rescheduling requests must be made at least 24 hours before the scheduled appointment time. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee of up to $75. Cancellation fees will be waived in the event of a pest or infestation hold as described in Section 9.
4.3 Service Windows
Appointment times are estimated arrival windows. We will make reasonable efforts to arrive within the scheduled timeframe but are not liable for delays caused by weather, traffic, emergency situations, or other unforeseen circumstances.
5. Quotes and Pricing
5.1 Estimates
Quotes provided are estimates based on the information you provide. Final pricing may vary based on actual conditions discovered during service delivery, materials required, and scope changes.
5.2 Price Changes
If the final cost will exceed the quoted estimate by more than 10%, we will notify you before proceeding. You will have the option to approve the additional costs or cancel the service.
5.3 Emergency Services
Emergency or after-hours services may be subject to additional fees, which will be clearly communicated at the time of booking.
6. Payment Terms
6.1 Payment Methods
We accept payment via cash, credit card, debit card, and ACH bank transfer through our secure payment platform. Payment information is encrypted and processed by our third-party payment processor.
6.2 Payment Due
Payment is due upon completion of services unless other arrangements have been made in writing. Invoices must be paid within 30 days of the invoice date. Past due accounts may be subject to a monthly late fee of 1.5% on the outstanding balance.
6.3 Deposits
For larger projects exceeding $1,000, we may require a deposit of up to 50% before commencing work. Deposits are non-refundable once work has begun, except in cases where we are unable to complete the service.
6.4 Materials and Supplies — Cancellation After Purchase
If a project is cancelled after Total Home Hero LLC has already purchased materials or supplies specific to your job, you are responsible for the cost of those materials. Materials purchased on your behalf become your property upon cancellation. We will provide an itemized list of materials purchased and their costs. Where possible, we will return unused materials to suppliers and credit any refunded amount to your account.
6.5 Disputed Charges
If you believe a charge is incorrect, you must notify us in writing within 15 days of receiving the invoice. We will investigate and respond within 10 business days.
7. Service Standards and Warranties
7.1 Quality of Work
We warrant that all services will be performed in a professional and workmanlike manner consistent with industry standards. If you are not satisfied with our work, you must notify us within 7 days of service completion to allow us the opportunity to address your concerns.
7.2 Warranty Period
Labor is warranted for 30 days from the date of service completion. Material warranties are governed by the manufacturer’s warranty terms. We are not responsible for failures due to misuse, neglect, or damage after service completion.
7.3 Limitation of Liability
Our total liability for any claim arising from our services shall not exceed the amount paid for the specific service in question. We are not liable for indirect, incidental, or consequential damages.
8. Customer Responsibilities
You agree to provide accurate information about the service needed; ensure safe and clear access to work areas; secure pets and remove obstacles before our arrival; be present or provide access to the property during scheduled appointments; notify us of any hazardous conditions or special requirements; and comply with any preparation instructions provided before the appointment.
9. Property Access, Safety, and Pest Policy
9.1 Property Access
By scheduling service, you grant our technicians permission to enter your property and access areas necessary to perform the requested work. You are responsible for ensuring that the work area is safe and accessible. We reserve the right to refuse service if conditions are deemed unsafe or if access is inadequate. Please ensure pets are secured during our visit.
9.2 Pest and Infestation Policy
Pest & Infestation Hold: If an active pest infestation is discovered or reasonably suspected at the property — including but not limited to insects (bed bugs, cockroaches, ants), rodents, or other vermin — Total Home Hero LLC reserves the right to immediately postpone or refuse service until the situation is resolved. Work will not resume until the customer provides written confirmation from a licensed pest control or extermination company certifying that the infestation has been professionally treated and cleared. This policy exists to protect the health and safety of our employees. Any cancellation or rescheduling fees will be waived under these circumstances.
10. Our Employees and Credentials
All work performed by Total Home Hero LLC is carried out by the owner or employees of Total Home Hero LLC under the supervision of our licensed Dwelling Contractor qualifier (License No. 3996-DCQ). All personnel working on your property are employed by and covered under Total Home Hero LLC’s insurance. We do not use independent subcontractors. Work involving lead-safe practices is performed in accordance with our Wisconsin lead-safe certified firm status (DHS Certification No. 2883900).
11. Photography and Media Release
By scheduling services with Total Home Hero LLC, you grant us the right to photograph and/or record work areas before, during, and after service completion for purposes including job documentation, quality assurance, portfolio development, and marketing. Photos and recordings may be used on our website, social media channels, printed materials, and other advertising. We will not include images that show identifiable personal information (such as faces, names, or identifying documents) without separate written consent. If you do not wish for your property to be photographed for marketing purposes, please notify us in writing prior to your scheduled appointment and we will restrict photography to internal documentation only.
12. Privacy and Data Protection
We collect and use your personal information in accordance with our Privacy Policy. By using our services, you consent to the collection, use, and sharing of information as described in our Privacy Policy. We implement reasonable security measures to protect your data but cannot guarantee absolute security.
13. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Total Home Hero LLC or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
14. User Conduct
You agree not to use our website for any unlawful purpose; attempt to gain unauthorized access to our systems; interfere with the proper functioning of the website; transmit viruses or malicious code; harass, abuse, or threaten our staff; provide false or misleading information; or use automated systems to access the website without permission.
15. Third-Party Links and Services
Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of service of these third parties. Your use of third-party services is at your own risk.
16. Indemnification
You agree to indemnify and hold harmless Total Home Hero LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your use of our services.
17. Force Majeure
We are not liable for delays or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather, pandemics, government actions, labor disputes, or utility failures.
18. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.
19. Termination
We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for any reason, including violation of these Terms. Payment obligations for services rendered will remain in effect upon termination.
20. Dispute Resolution
20.1 Informal Resolution
In the event of any dispute, both parties agree to first attempt to resolve the matter through good faith negotiations for a period of 30 days.
20.2 Arbitration
Any dispute that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in central Wisconsin. Each party shall bear its own costs and fees.
20.3 Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.
21. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin. Any legal action must be brought in the state or federal courts located in central Wisconsin.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
23. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Total Home Hero LLC regarding the use of our services.
